The Failure of the 28-Article Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the crisis sparked by the presentation of a new comprehensive peace framework for achieving ceasefire appeared – briefly – to have been defused. A Washington representative spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, Moscow made its countermove: another massive barrage of missile and drone strikes on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of contrasting events captured the harsh reality of the outgoing year. By day, political struggles are waged: positive announcements are released from multiple capitals. Significant resources is expended on containing particular approaches. By night, the Kremlin clearly shows the world that, for them, war remains the primary tool for achieving "settlement".

Nocturnal Warfare

As military strikes progressed into the early hours of Tuesday, the immediate reality of Ukraine's exposure was revealed. Ukraine is capable of detecting projectile deployments from Russian territory, a capacity enabled by current data. From observation points, defense planes that had been deployed to engage hostile aerial threats flew past – advanced fighter aircraft supplied to Ukraine by NATO members.

Shortly after, Kyiv's missile defense activated: several firings targeted at a incoming threat. This was a sophisticated defense system at work, presumably provided by allied countries. Every firing jolts you unexpectedly, shaking the windows. The moment of terror quickly transforms into sober acceptance: possibly the hostile projectile won't cause damage this time, preventing destruction from devastation and further power outages.

Ongoing Risks

Not long after, a heavy machine gun opened up on a aerial vehicle in the vicinity, part of a mobile-fire group – most likely Western-made equipment. Regrettably, the shots failed to hit the opposing UAV – it continued its flight toward its destination.

With pauses, this carried on until dawn. Kyiv awoke to the morning news: multiple fatalities, destruction and heating outages in numerous residences as a result of the night's assault. As customarily, everyone still continued their routines – experiencing conflict. But those full day demonstrated Ukraine's critical military reliance on international aid – a reliance that European nations are demonstrably unable to replace in the short term.

Ineffective Peace Efforts

The detailed framework from US administration sparked intense emotion, controversy and deep concern – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after previous diplomatic encounters and international summits.

Every new proposal from Washington follows the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They manage the tension but never actually achieve victory. This cycle will, no doubt, endure.

Tactical Assessments

It is easy to blame specific actors of repeatedly advocating Kremlin's demands. But that does not seem to be the whole story. American leadership functions according to a principle familiar among international relations experts: you cannot win at the negotiating table what you have been unable to protect through force. The American government assumes that it is impossible to compel Moscow to relinquish the territory that it currently occupies in Ukraine's southern or eastern regions.

The issue is that while accepting these circumstances, US leadership does little to discourage Russia, through diplomacy or military means, from believing that the current condition will not evolve additionally in its benefit in the coming year.

Opposing Positions

Therefore, the Kremlin is convinced that duration works to their advantage – that Ukraine and its partners are nearing depletion. Their motivation to agree to terms that does not give them the greatest potential benefit is close to zero. There may be many attempts to achieve ceasefire, but they will persist as long as Russia's government remains highly assured in the result.

On the contrary, Ukraine's government believes that Ukraine can still endure, slowly losing civilians and areas but avoiding a total frontline collapse until conditions improve in its favour.

Present Conditions

Objectively, there are no genuine requirements for a truce. Now, subjective factors are becoming relevant: political desires to negotiate peace and obtain worldwide acknowledgment, and the government's double obstacles – on one hand, not to alienate a key ally, and on the other, to unite the population around the national cause against any proposal Kyiv finds unsuitable, so that their attention does not switch to internal issues. And although their task will now be much harder after recent developments, it remains highly unlikely that this will modify their basic position.

These opposing factors are guiding negotiations.

Summary and Prospects

It took a only one week to eliminate the 28 points of the latest plan. Forceful and unpredictable management of the matter by Washington, pushback by Ukraine and the remaining European nations, along with pacifying measures of diplomats, and finally, recent disclosures, all served their function.

While new initiatives based on old ideas are imminent, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are founded on Moscow's terms and demonstrate specific hesitation to change the course of events, if they maintain solidarity and strengthen their defence capabilities at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the predictable period, largely rely on ongoing international assistance.
